Sacked by text - what are your rights?


A recent unfair dismissal case in the Fair Work Commission highlights the importance of procedural fairness when an employer decides to terminate an worker's employment. The employee was dismissed because she was allegedly unreliable. The employer sent her an SMS with the bad news. The Fair Work Commission decided that although there might have been a valid reason for the dismissal. It was ultimately an unfair dismissal because she did not have an opportunity to respond. The text message was simply sent to the employee telling her not to come back to work. The Commission called the decision "gutless" as the employer didn't give the employee a chance to explain herself and convince the employer to make a different decision. If employees are unsure of their rights, they should seek the advice of a professional. Lodging an unfair dismissal application may be an option, depending on the circumstances.
